This section gives details of current Legal Instruments granted for Anglian Water by the Drinking Water Inspectorate (DWI) on behalf of the Secretary of State. A Legal Instrument can be either a Regulation 28 Notice, an Authorised Departure or Undertaking as detailed below:
Notices
A Notice is authorised by the DWI on behalf of the Secretary of State under Regulation 28 of the Water Supply (Water Quality) Regulations 2000 (as amended) following any Regulation 27 risk assessment which states that there is, or has been, a significant risk of supplying water that would constitute a potential danger to human health.
Authorised Departures
An Authorised Departure can be granted by the DWI under Regulation 20 of the Water Supply (Water Quality) Regulations 2000 (as amended). Under the terms of an Authorised Departure, a company is allowed to supply water which does not meet the standard for a particular parameter, providing there is no risk to public health, until work to install a suitable process to ensure compliance with the standard is completed.
Consultation must be carried out with Health Protection Units, and a maximum value for the parameter must be agreed and approved by the DWI. Authorised Departures have a maximum time period of three years and progress is closely monitored by the DWI.
Anglian Water currently has no Authorised Departures in place.
Undertakings
An Undertaking can be granted by the DWI under Section 19(1) (b) of the Water Industry Act 1991 for national parameters where non-compliance with the Water Supply (Water Quality) Regulations 2000 (as amended) occurs as a result of mans activities or pollution incidents. Under the terms of an Undertaking, a company is required to complete a programme of work to ensure compliance with the relevant standard.
Maintenance Undertakings
A Maintenance Undertaking is granted within a Public Water Supply Zone (PWSZ) following multiple compliance monitoring sample failures for a particular parameter. As part of this Undertaking, the company must undertake a programme of maintenance work to ensure compliance with the particular standard.
Following the successful completion of our Peterborough City West Maintenance Undertaking, and subsequent sign-off by the DWI, Anglian Water currently has no Maintenance Undertakings in place.
AMP Undertakings
Asset Management Period (AMP) Undertakings are granted by the DWI for Water Treatment Works (WTWs) or PWSZs where the company has identified exceedances of the standard or where exceedances are likely to occur. A Programme of Work is developed for each Undertaking and is closely monitored by the DWI. Following completion of each scheme, 12 months routine monitoring is required by the Undertaking to ensure the scheme has been effective.
